Terms of use

These Terms of Use ("Terms") govern your access to and use of the Hazri mobile application and the website at hazri.co (together, the "Service"), provided by Kaivon Technologies Private Limited ("Kaivon", "we", "us" or "our").
By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
In short
This summary is provided for convenience and does not replace the sections that follow.
- Hazri is a private record of attendance and wages that you keep for yourself.
- Hazri does not pay anyone, hold money, or transfer funds. You pay your workers as you always have.
- The figures the Service calculates are derived from what you enter. You remain responsible for what you pay.
- We intend to charge for the Service, or for some of its features. You will be told the price before any charge applies, and nothing is charged without your agreement.
- The Service is provided without warranty.
1. Eligibility
You must be at least eighteen (18) years of age and capable of entering into a binding contract under the Indian Contract Act, 1872 to use the Service. The Service is not directed at children.
2. Description of the Service
The Service enables you to record daily attendance, rates of pay, advances and settlements in respect of persons you engage, and to calculate balances arising from those records.
The Service is a record-keeping tool. It is not a payment service, a payroll bureau, a lending service, a banking service, an accounting service or a provider of legal, tax or employment advice. Kaivon does not hold, transmit, disburse or take custody of funds at any time, and is not a party to any arrangement between you and any person whose details you record.
3. Your account
You are responsible for maintaining the confidentiality of the credentials used to access your account and for all activity occurring under it. You agree to notify us promptly at hello@kaivon.in if you become aware of unauthorised use.
We may suspend or terminate an account where we reasonably believe these Terms have been breached, or where suspension is necessary to comply with law or to protect the Service or its users.
4. Your records and your responsibilities
You retain all rights in the records you create. You grant us only the limited licence necessary to store, process and display those records to you in order to operate the Service.
You represent and warrant that:
- you have the right to record the details of each person you enter, and where those details constitute personal data of another individual, you have a lawful basis for recording them;
- you will not use the Service to record unlawful content, or to harass, defame or endanger any person; and
- you will comply with all laws applicable to your engagement of the persons whose details you record, including any law relating to minimum wages, working hours and record-keeping.
Where you record another person's name, telephone number, address, photograph or wage details, you determine the purposes of that recording. Our role in respect of such data is limited to storing and processing it on your instruction through the Service.
5. Accuracy of calculations
Balances, earnings and settlement figures are computed arithmetically from the records you enter. They are only as accurate as those records.
The Service is designed so that a period once settled is not paid again, and so that a change to a rate does not alter a period already settled. You remain solely responsible for verifying every amount before you pay it. Kaivon accepts no liability for any payment made or withheld in reliance on a figure shown by the Service.
6. Acceptable use
You will not, and will not permit any person to:
- access the Service other than through the interfaces we provide;
- attempt to gain access to data belonging to another account;
- interfere with, disrupt, or place unreasonable load upon the Service or its infrastructure;
- reverse engineer, decompile or disassemble any part of the Service, save to the extent such restriction is prohibited by applicable law; or
- use the Service to build a competing product or service.
7. Availability and changes to the Service
The Service is provided on an "as available" basis. Certain features require an internet connection, including signing in, restoring your records on a new device and synchronising records between devices. We do not warrant that the Service will be uninterrupted, timely or error-free.
We may add, modify or discontinue features. Where we discontinue the Service in its entirety, we will give reasonable notice and a reasonable opportunity to obtain your records.
8. Charges and paid features
8.1 We intend to monetise the Service. We may introduce subscription plans, one-time purchases, paid features or other charges, and may change or withdraw any of them, at our discretion. Nothing in these Terms promises that the Service, or any feature of it, will remain free of charge.
8.2 We will not charge you without first showing you the price and what it covers, and without your agreement through the purchase process. Prices are shown in the application or in the app store before purchase and may include applicable taxes.
8.3 Where you purchase through the Google Play Store or the Apple App Store, payment, billing, renewal, cancellation and refunds are handled by that store under its own terms. You can manage or cancel a subscription from your store account.
8.4 Where a feature you have been using without charge becomes a paid feature, we will give you reasonable notice before the charge applies. You may stop using the Service rather than pay, and you may delete your account at any time as described in section 10.
9. Intellectual property
The Service, including its software, design, text and marks, is owned by Kaivon and protected by applicable law. These Terms grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for its intended purpose. No other rights are granted.
10. Termination
You may stop using the Service at any time and may delete your account as described in our Privacy policy. Deletion is irreversible and removes your records within thirty (30) days.
Sections 5, 9, 11, 12, 13 and 14 survive termination.
11. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
12. Limitation of liability
To the maximum extent permitted by applicable law, Kaivon shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, goodwill or data, arising out of or in connection with the Service, whether in contract, tort (including negligence) or otherwise, even if advised of the possibility of such loss.
To the maximum extent permitted by applicable law, Kaivon's aggregate liability arising out of or in connection with the Service shall not exceed one thousand Indian Rupees (INR 1,000).
Nothing in these Terms excludes or limits liability which cannot lawfully be excluded or limited.
13. Indemnity
You agree to indemnify and hold harmless Kaivon and its directors, officers and employees against any claim, demand, loss or expense (including reasonable legal fees) arising out of your use of the Service, your records, or your breach of these Terms or of any law.
14. Governing law
These Terms are governed by the laws of India, without regard to conflict of law principles. The courts of India shall have jurisdiction in respect of any dispute arising out of or in connection with these Terms.
15. General
If any provision of these Terms is held unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation, merger or transfer of business.
These Terms, together with the Privacy policy, constitute the entire agreement between you and Kaivon in respect of the Service.
16. Changes to these Terms
We may amend these Terms. Where an amendment materially affects you, we will publish the amended Terms at this address under a new version number and date. Your continued use of the Service after publication constitutes acceptance.
